Effective date: January 1, 2026
These Terms of Service (“Terms”) govern your use of VisionTagger (the “App”) and the VisionTagger product website (the “Website”). By downloading, installing, accessing, or using the App or Website, you agree to these Terms.
If you are a consumer, you may have mandatory rights under applicable consumer protection laws. Nothing in these Terms limits those rights where doing so is not permitted.
1. Who we are
The App and Website are provided by Synendo (“we”, “us”, “our”).

2. Purchases, payments, refunds, and taxes (FastSpring as Merchant of Record)
VisionTagger is sold through FastSpring, acting as the Merchant of Record. This means:
- FastSpring is the seller for the transaction and handles payment processing, tax/VAT collection and remittance, invoicing, and payment-related customer service.
- Refunds, chargebacks, and payment disputes are handled through FastSpring, according to FastSpring’s policies and the terms presented during checkout.

2.1 Trial-first and familiarity with the App
We encourage you to use the App’s trial to determine whether VisionTagger fits your needs.
To the extent permitted by applicable law, when you purchase VisionTagger we assume you have had a reasonable opportunity to evaluate the App and are familiar with its core functionality, limitations, and system requirements.
This section does not limit any mandatory rights you may have as a consumer under applicable law.
2.2 Refund policy
If you want to request a refund after purchasing the App, please email apps@synendo.com and include:
- the email address used at checkout,
- your order reference, and
- a brief explanation of the reason for the refund request.
We will review your request and, if approved, we will initiate the refund process with FastSpring. Refunds are issued back to the original payment method where possible, subject to FastSpring’s processing rules.
Refund amounts
- Within 30 days of purchase: we will provide a full refund when your request is approved.
- After 30 days from purchase: we may provide a partial refund when your request is approved, taking into account factors such as the time since purchase and support or processing costs.
Nothing in this section limits or replaces any mandatory refund or withdrawal rights that may apply to you under consumer protection laws.
2.3 Effect of a refund: license deactivation and continued use
If a refund is issued (full or partial), your license for VisionTagger will be terminated for the refunded purchase. This means:
- your license key may be deactivated or revoked, and
- you must stop using the App and delete any copies in your possession (except to the extent you are permitted to keep a copy under applicable law).
2.4 Repurchase after a refund
Licenses are tied to the email address used at checkout and for license activation.
If you receive a refund, the email address used for that refunded purchase may become ineligible for repurchase of VisionTagger in the future. If you wish to buy the App again later, you may be required to use a different email address.
We may make exceptions at our discretion (for example, if a refund was issued due to a technical compatibility problem and later resolved), but we are not obligated to do so.
3. Definitions (versioning)
For purposes of these Terms:
- “Version” means a release of the App identified by a major and minor number (for example, 1.0.0, 1.5.1, 2.0.0).
- “Major Version” means a release where the first number changes (for example, 1.x to 2.0).
- “Minor Update” means a release where only the minor/patch number changes within the same Major Version (for example, 1.2.0 to 1.3.0 or 1.3.1).
- “Update” means a Minor Update and/or patch, bug fix, security fix, or compatibility update we make available for the App.
- “Upgrade” means a new Major Version (for example, 2.0.0) or any release we designate as a paid upgrade.
4. License grant
Subject to these Terms and your compliance with them, we grant you a personal, non-transferable, non-sublicensable license to install and use VisionTagger in object code form:
- License type: per user
- Term: perpetual (no end date) for the licensed Major Version, unless terminated for breach under these Terms
- Commercial use: permitted, provided that any third-party model(s) you use with the App permit commercial use under their respective licenses
- Version scope: your license grants you the right to use the Major Version of the App that was made available to you at the time of purchase (for example, version 1.x). Your license does not include the right to receive or use future Major Versions (for example, version 2.0.0), unless you separately purchase an Upgrade or we expressly provide it at no additional charge.
You may install and use the App on multiple devices that you own or control, provided it is for your personal use as the licensed user. You may not transfer your license to another person or entity.
You acknowledge that a “perpetual” license means the license has no fixed end date for the licensed Major Version, not that the App will receive Updates indefinitely or that future Major Versions are included. The App is currently compatible with macOS 26 (“Tahoe”); we will use commercially reasonable efforts to support future macOS versions, but we cannot guarantee compatibility with all future macOS releases.
5. License activation and keys
The App requires a license key to activate. You are responsible for keeping your license key confidential and for any use of your license key.
We may suspend or revoke license activation in cases of fraud, misuse, or material breach of these Terms.
6. Updates and upgrades
6.1 Updates (within a Major Version)
We may release Updates for a Major Version to fix bugs, address security issues, improve compatibility, or add or adjust features within that Major Version. If we release Updates for the Major Version covered by your license, you may download and use those Updates while your license remains valid.
Our support period for a Major Version is determined by the lifecycle of that Major Version. We currently intend to support a Major Version for at least 12 months from the initial release of that Major Version (for example, from version 1.0.0), but we may stop providing Updates earlier or later, including as described in Section 6.3, except to the extent required by applicable law.
We do not guarantee any particular Updates, frequency, duration, or continued availability of Updates, except to the extent required by applicable law.
6.2 Upgrades (new Major Versions)
New Major Versions (for example, a change from 1.x to 2.0) may include significant new features and may be offered as a paid Upgrade or as a separate product. Your license for a prior Major Version does not include access to or use of a new Major Version unless you purchase the Upgrade (or we expressly provide it at no additional charge).
6.3 End of Updates upon release of a new Major Version
When we release a new Major Version, we may stop providing Updates for the prior Major Version. Specifically, once version 2.0 (or any later Major Version) is released, the immediately prior Major Version will no longer receive Updates.
You may continue using the last available release of the Major Version you licensed, subject to these Terms.
6.4 Upgrade pricing
We may, at our discretion, offer discounted Upgrade pricing to existing customers, but we are not obligated to do so. Any Upgrade pricing, discount, or eligibility will be determined at the time of purchase.
7. Your content and your responsibility
VisionTagger processes images and generates metadata on your Mac. You are responsible for:
- ensuring you have the rights to process the images you select,
- reviewing generated metadata before publishing or relying on it,
- using the outputs in a way that complies with applicable laws and third-party rights.
We do not review your images, and we do not guarantee that generated metadata is correct, complete, or suitable for any particular purpose.
8. Model downloads and third-party licenses
VisionTagger can download or use third-party models. Model licenses vary. You are responsible for ensuring your use of any model complies with the applicable license and terms (including any restrictions on commercial use, redistribution, or attribution).
The App may also include or rely on third-party open-source components. Those components are governed by their respective licenses, and additional terms may apply. For an overview of these licenses, see the “About VisionTagger” menu option in the App.
9. ExifTool dependency for XMP/embedded metadata
Certain export options (such as XMP sidecar creation and embedding XMP metadata into image files) require ExifTool (https://exiftool.org), which must be installed separately.
ExifTool is third-party software governed by its own license and terms. We are not responsible for third-party software you install, nor for issues caused by its operation, configuration, or updates.
10. Acceptable use
You agree not to:
- use the App or Website in violation of applicable laws or regulations,
- interfere with or disrupt the App, Website, licensing, or update infrastructure,
- attempt to circumvent license controls,
- use the App in a way that could reasonably be expected to damage, disable, or impair the App or Website.
11. Intellectual property
We and our licensors retain all rights, title, and interest in and to the App and Website, including all intellectual property rights. These Terms grant you only a limited license to use the App as described above, and do not transfer any ownership rights.
12. Disclaimer of warranties
To the maximum extent permitted by law, the App and Website are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Generated metadata may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and correcting it before relying on it.
13. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill.
- Our total liability for all claims relating to the App or Website will not exceed the amount you paid for the App in the 12 months preceding the event giving rise to the claim (or, if no amount was paid, EUR 0), unless applicable law requires otherwise.
Some jurisdictions do not allow certain limitations; in that case, the limitations apply to the maximum extent permitted.
14. Termination
We may terminate or suspend your rights under these Terms if you materially breach them. Upon termination, you must stop using the App and delete all copies in your possession.
Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limitation of liability) will survive.
15. Changes to the App or Terms
We may modify the App (including features) and may update these Terms from time to time. Updated Terms will be posted on the Website with a revised effective date. Continued use after the effective date constitutes acceptance.
16. Governing law and jurisdiction
These Terms are governed by the laws of The Netherlands, excluding conflict-of-law rules. The courts located in The Netherlands will have exclusive jurisdiction, unless mandatory consumer protection laws provide otherwise.
